For Sale by Owner (FSBO)

In this highly competitive real estate market, many home sellers are electing to go without a real estate agent, and this can be a wise decision in the right circumstances. If your home is unique, higher value, or otherwise may be difficult selling, a real estate agent is invaluable. If your home is priced similar to other family homes in the Kansas City area, or in one of the highly active neighborhoods, such as Prairie Village, where homes are selling the same day, the value in a listing agent may be more limited. Moreover, there is often limited value in hiring a real estate agent to handle a transaction between a wholeseller and flipper or when the seller already has a buyer.

Although you may not need a real estate agent to market and show your property, it is still advisable to hire someone to assist with drafting the contract and any necessary addendums. This both helps to ensure that your deal goes through, but also helps to lower the risk that you are sued after the transaction for not providing the necessary disclosures.

Although a real estate agent can prepare contracts on standard forms when acting as your real estate agent, he or she is legally prohibited by both the Kansas Real Estate Commission and Missouri Real Estate Commission from preparing contracts for you when they are not acting as an agent or transaction broker in the transaction. Moreover, while you can hire a real estate agent as a transaction broker, those costs are usually higher than hiring a real estate attorney to prepare your contract.

Also, please note that online forms, such as the Kansas City Regional Association of Realtors (KCRAR) or Kansas Association of Realtors (KAR) forms are copyrighted and cannot legally be used by non-Realtors (R). This is where hiring a lawyer who is also a broker can help as in that case the lawyer can use the forms so as to keep the costs reasonable without violating either the real estate commission regulations or the copyright restrictions. Similarly, many other form contracts you may find online are copyrighted or do not contain the state specific language, such as the required radon and KBI disclosures in Kansas real estate contracts.
