Warranty Deed
$205.00
A warranty deed is the most common deed used to transfer ownership in a standard real estate transaction. A warranty deed transfers ownership and is a promise from the seller that he or she owns the property. Please see below for more information.
A deed is the document that transfers ownership of real estate from own person to another. A warranty deed is a deed that both transfers ownership and promises that the person transferring ownership is the owner of the property. A warranty deed is the most common type of deed used for the purchase and sale of a home.
The deed is generally a one- to two-page document and it is recorded with the county register of deeds office. Once the deeds is recorded, the public is considered to have notice to the transfer of ownership in the property and an attempt to re-transfer the property to a third party would be invalid. Unlike a contract, the only person that has to sign the deed is the person transferring ownership in the property. That party does, however, have to obtain a notary for the document to be valid. Once the deed is signed, notarized, and delivered to the person receiving the interest in the property, the ownership interest is transferred. If there is a prior mortgage or other liens against the property, the person receiving the property receives it “subject to” the mortgage or lien. In other words, the lender maintains the right to foreclose on the property and remove the purchaser from the home.
This service includes a single phone call to determine the purpose for drafting the deed and the appropriate deed type. After the consultation, we will draft the appropriate paperwork and provide it to the client for execution. Once signed and notarized, we will file the deed with the county and provide the client with the file-stamped copy of the deed for his or her records.
